Transparency in insolvency proceedings appears a cardinal principle for any office-holder:
The Civil Service Code (CS Code) (which seems applicable to the Insolvency Service) arising from Section 5 of the Constitutional Reform and Government Act 2010; appears replete with references to and inferences conceivably capable of being drawn, of the principle of fairness to be deployed.
The CS Code says as follows:
“… and handle information as openly as possible within the legal framework”
In the case of Insolvency Practitioner Code of Ethics a similar principle appears broadcast:
“… an Insolvency Practitioner in the role as office holder has a professional duty to report openly to those with an interest in the outcome of the insolvency.”
